Building defects occur when building components do not meet the design standards prescribed by the Building Code of Australia or relevant Australian Standards. They can also occur when building components are not installed in accordance with the manufacturer’s requirements or erected incorrectly.
Defects become obvious when components fail or other problems arise within the structure.
Left unfixed these defects can adversely affect the value of the property.
Often these problems are visible. Other times, the failure is less obvious but results in other issues within the structure.
Rectification of building defects can normally be negotiated with the Builder. Failing that process, in New South Wales the Consumer, Trader and Tenancy Tribunal (CTTT) which is now known as NSW Civil and Administrative Tribunal (NCAT) can determine disputes between builders and owners. Other States have similar dispute resolution procedures.
