The State of New South Wales has a legislative framework known as the Land Acquisition (Just Terms Compensation) Act 1991, which sets out the “heads” of compensation. The legislation is complex, and codified, requiring an extensive examination of the property being acquired and identifying compensation which is justified and supported by available evidence.
